Although established since 2008, the purpose and powers of the Company Names Tribunal are still not generally well understood. It is a forum through which an aggrieved third party can file a complaint about the name of a company or an LLP which is similar to a name in which it owns goodwill.  While a complaint to the Tribunal is not an alternative to a trade-mark-infringement or passing-off claim, it can however be a useful adjunct. It can be used as a comparatively inexpensive tool to obtain the practical relief of a change of name. We advise on the merits of filing complaints with the Company Names Tribunal as well as the possible pitfalls and how to anticipate and best navigate issues that may arise during the complaint process and file or defend complaints.
