Venner Shipley featured in World IP Review

James Tumbridge, Robert Peake and Benedict Sharrock Harris wrote an article for WIPR World Intellectual Property Review on the recent Audi and VW’s feud with online retail platform Fruugo before the District Court The Hague. The Court concludes that Fruugo does not directly infringe Audi Volkswagen’s trade mark rights by displaying ads containing infringing, inferior products on its own online sales platform and neither does it act unlawfully because it can rely on the platform liability exception.
